Terms of Service

  • These Terms of Service ("Terms") govern your access to and use of the PCBWay website, online quotation tools, ordering platform, manufacturing services, assembly services, customer support, and other related services provided by PCBWay.
SECTION 1 - INTRODUCTION AND ACCEPTANCE OF TERMS
This website is operated by PCBWay. Throughout the Site, the terms "PCBWay," "we," "us," and "our" refer to the relevant PCBWay entity providing the website, products, or services to you. PCBWay may operate through different legal entities, websites, and affiliates, including PCBWay.com, PCBWay.es, PCBWay.jp, and PCBWay.fr.
By accessing or using the Site, creating an account, submitting files, requesting a quotation, placing an order, or purchasing any standard or custom products or services from PCBWay, you agree to be bound by these Terms and any additional policies referenced herein or made available by hyperlink, including our Privacy Policy and Return Policy.
If you do not agree to these Terms, you may not access the Site or use our services. Placing an order through the PCBWay website constitutes your acceptance of these Terms and forms a legally binding agreement between you and the relevant PCBWay entity.
SECTION 2 - ACCOUNT REGISTRATION AND RESPONSIBILITIES
To use certain features of the Site, you may need to register for an account and provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account, except where caused by PCBWay’s own fault or system security failure.
You must promptly notify PCBWay of any unauthorized or suspected unauthorized use of your account. PCBWay may suspend, restrict, or terminate your account in accordance with these Terms, including where we reasonably believe there is a breach of these Terms, inaccurate information, security risk, legal risk, compliance risk, or other legitimate business reason.
You may delete your account at any time, subject to outstanding orders, payment obligations, legal retention requirements, quality assurance records, dispute resolution, compliance obligations, and legitimate business record-keeping purposes.
SECTION 3 - ORDERS, QUOTATIONS, AND CUSTOMER FILES
PCBWay provides custom manufacturing and related services based on the information, files, drawings, specifications, and order details submitted by you. You are responsible for ensuring that all files, data, specifications, quantities, materials, finishes, tolerances, delivery addresses, billing information, and other order details are accurate, complete, and suitable for the intended purpose.
Online quotations are based on the information submitted by you and are subject to engineering review, file verification, manufacturing feasibility, material availability, compliance review, and final order confirmation by PCBWay. PCBWay may adjust the quotation, request additional information, or cancel an order if the submitted files or specifications do not match the information entered, are incomplete, are technically infeasible, or create legal, compliance, or manufacturing risks.
If an order is cancelled after payment due to PCBWay’s inability to process or accept the order, PCBWay will refund the applicable amount through the original payment method where reasonably possible.
SECTION 4 - TRADE COMPLIANCE AND RESTRICTED PRODUCTS
You agree to comply with all applicable export control, sanctions, customs, anti-diversion, and trade compliance laws and regulations, including but not limited to the laws and regulations of China, the United States, the European Union, the United Kingdom, the United Nations, and other applicable jurisdictions.
You may not submit, upload, request, purchase, or use PCBWay’s services for any product, file, design, part, component, material, or end use that is illegal, prohibited, weapon-related, military-restricted, or subject to applicable export control or sanctions restrictions, including but not limited to items controlled under ITAR, EAR classifications beyond EAR99, EU Dual-Use regulations, or other applicable export control laws.
You represent and warrant that, to the best of your knowledge after reasonable due diligence, neither you, your affiliates, ultimate beneficial owners, directors, senior management, authorized representatives, nor the end users related to your order are subject to applicable sanctions, export control restrictions, or trade restrictions.
You further represent and warrant that the products, files, designs, components, materials, and services related to your order will not be sold, exported, re-exported, transferred, diverted, resold, leased, or otherwise supplied, directly or indirectly, to any restricted party, restricted destination, or restricted end use in violation of applicable laws or PCBWay’s compliance policies. Restricted destinations may include, without limitation, Cuba, Iran, Syria, Sudan, North Korea, Russia, Belarus, Crimea, Donetsk, Luhansk, Armenia, Kazakhstan, Kyrgyzstan, Venezuela, and any other countries, regions, persons, entities, or end uses restricted under applicable laws, regulations, sanctions programs, or PCBWay’s internal compliance review.
Restricted end uses include, without limitation, military end uses, military intelligence end uses, weapons, ammunition, unmanned combat systems, weapons of mass destruction, nuclear, missile, chemical or biological weapons applications, or uses involving human rights violations.
PCBWay may require end-user statements, end-use certificates, export control classification information, export licenses, sanctions screening information, or other compliance documents reasonably necessary for review. PCBWay may refuse, suspend, cancel, or terminate any order or service where we reasonably believe there is a legal, sanctions, export control, customs, or compliance risk, or where you fail to cooperate with reasonable compliance review requests.
PCBWay does not provide standalone electronic component sales. Components are procured on a project basis from authorized or reputable suppliers and are used solely for assembly in customer PCBA orders.
SECTION 5 - CUSTOMER DATA, INTELLECTUAL PROPERTY, AND CONFIDENTIALITY
Your submission of personal information through PCBWay is governed by our Privacy Policy. Ownership of any files, data, drawings, designs, specifications, or other materials uploaded or submitted by you remains with you or your licensors. Your designs and related intellectual property remain your property.
By submitting Customer Data or User Content to PCBWay, you grant PCBWay a non-exclusive, worldwide, royalty-free, limited license to access, use, process and review such data solely to the extent necessary for the purpose of providing quotations, manufacturing and delivering the ordered parts, performing engineering review, providing customer support, carrying out quality assurance, conducting compliance review, and improving our internal manufacturing processes and technologies related to the services requested by you.
This license is non-transferable and non-sublicensable, and will automatically terminate upon completion of the related order, except where retention is required by law, regulation, quality assurance, dispute resolution, compliance, or legitimate business record-keeping purposes.
PCBWay shall not sell, disclose, copy, modify, distribute, or use your Customer Data or User Content for any third-party benefit or for any purpose unrelated to your order without your prior written consent. PCBWay will not use your technical files, designs, drawings, specifications, or other Customer Data to train artificial intelligence models, machine learning systems, or pricing algorithms without your prior written consent.
Any Customer Data or User Content containing confidential or proprietary information remains subject to PCBWay’s Privacy Policy, these Terms, and any applicable Non-Disclosure Agreement between you and PCBWay.
SECTION 6 - PUBLICITY AND CUSTOMER REFERENCES
PCBWay will not use your trademarks, logos, company name, personal name, product images, project information, or other identifying materials for marketing, advertising, press releases, interviews, promotional materials, presentations, or customer reference purposes without your prior consent.
Any technical files, designs, drawings, specifications, confidential information, or proprietary content provided by you will continue to be protected under the confidentiality provisions of these Terms, PCBWay's Privacy Policy, and any applicable Non-Disclosure Agreement.
SECTION 7 - PRODUCTS, SERVICES, AND QUALITY
PCBWay will use commercially reasonable efforts to manufacture products in accordance with the confirmed order specifications, accepted production files, and applicable quality standards. However, PCBWay does not guarantee that the products will meet requirements not expressly confirmed in the order.
Certain products or services may be available exclusively online through the Site and may be subject to availability, manufacturing capability, material availability, compliance review, and order acceptance by PCBWay. PCBWay may limit, suspend, or discontinue any product or service, or limit sales to any person, geographic region, or jurisdiction, where reasonably necessary for legal, compliance, operational, security, or business reasons.
Product images, colors, descriptions, materials, and technical information displayed on the Site are provided for general reference. Actual results may vary depending on manufacturing processes, materials, finishes, tolerances, monitor display, and order specifications.
Returns, refunds, remakes, or exchanges are subject to PCBWay's Return Policy and applicable after-sales procedures.
SECTION 8 - PRICES, PAYMENT, AND SURCHARGES
Prices for PCBWay products and services may change from time to time. The price shown during online quotation is based on the information submitted by you and becomes binding only after PCBWay confirms the order and reviews the submitted files where applicable.
PCBWay may revise the price, request additional payment, or cancel the order if the submitted files, specifications, materials, quantities, delivery requirements, or other details differ from the information used for the quotation. Additional charges may apply, including but not limited to logistics fees, bank or payment processing fees, VAT, import duties, DTP service fees, customs clearance-related charges, remote area fees, storage fees, or other charges displayed at checkout or communicated during order processing.
You agree to provide current, complete, and accurate billing, payment, shipping, and account information for all orders. PCBWay may refuse, suspend, or cancel orders where payment information is inaccurate, payment is declined, fraud is suspected, or compliance review is not completed.
SECTION 9 - SHIPPING, CUSTOMS, DUTIES, AND TAXES
Unless otherwise stated at checkout or confirmed by PCBWay in writing, customs duties, VAT, import taxes, brokerage fees, and other customs-related charges are not included in the product price or shipping cost and remain your responsibility.
If you select and pay for an available tax-inclusive or duty-paid service, such as IOSS, DTP, DDP, or another customs duty/VAT service shown at checkout, the covered taxes or duties will be handled according to the terms of that selected service. Charges or obligations not covered by the selected service remain your responsibility.
Customs duties, taxes, clearance requirements, and import rules may vary by destination country, product type, value, weight, declared information, and local customs policies. You are responsible for confirming applicable import requirements with your local customs authority where necessary.
PCBWay is not responsible for delays, inspections, seizures, penalties, storage fees, or additional charges caused by customs authorities, incomplete or inaccurate information provided by you, import restrictions, or circumstances beyond PCBWay’s reasonable control. Shipping terms, delivery timelines, risk transfer, and customs responsibilities may vary depending on the selected logistics method and applicable Incoterms or shipping service terms.
SECTION 10 - DELIVERY CONFIRMATION AND AFTER-SALES CLAIMS
After PCBWay ships an order, you are responsible for monitoring delivery and confirming receipt within the applicable confirmation period. Unless otherwise stated, the automatic receipt confirmation period is generally 30 days from shipment for express logistics methods such as DHL, FedEx, UPS, SF, OCS, or USPS, and generally 60 days from shipment for postal, standard, air freight, sea freight, or other logistics methods.
If you do not confirm receipt or submit a valid after-sales claim within the applicable period, the order may be automatically marked as received and completed. Automatic receipt confirmation does not waive your right to raise valid quality, shortage, damage, or non-conformity claims within the applicable after-sales or warranty period under PCBWay's Return Policy.
SECTION 11 - WEBSITE INFORMATION, ERRORS, AND SERVICE CHANGES
PCBWay strives to keep website information accurate and up to date, but information on the Site may contain typographical errors, inaccuracies, omissions, outdated information, or general reference materials. PCBWay may correct errors, update information, change product descriptions, revise pricing, or cancel orders affected by inaccurate information, including after an order has been submitted.
PCBWay may modify, suspend, or discontinue any part of the Site, tools, products, or services where reasonably necessary for operational, security, legal, compliance, or business reasons. PCBWay will not be liable for reasonable changes, suspensions, or discontinuance of website features or services, except as required by applicable law or expressly agreed by PCBWay.
SECTION 12 - OPTIONAL TOOLS AND THIRD-PARTY LINKS
PCBWay may provide access to third-party tools, links, websites, payment services, logistics providers, or other third-party services. Such third-party services are provided by independent third parties and may be subject to their own terms, policies, and practices.
PCBWay does not control and is not responsible for third-party websites, tools, services, content, products, or transactions, except to the extent required by applicable law. You should review the applicable third-party terms before using or relying on any third-party service.
SECTION 13 - USER COMMENTS, FEEDBACK, AND SUBMISSIONS
If you submit comments, suggestions, ideas, feedback, reviews, contest entries, or other non-confidential materials to PCBWay, PCBWay may use such feedback to improve its Site, products, and services.
This Section does not apply to Customer Data, technical files, product designs, manufacturing files, drawings, specifications, confidential information, proprietary information, or order-related materials submitted for quotation, manufacturing, assembly, engineering review, quality assurance, or compliance review. Such materials are governed by Section 5 of these Terms, our Privacy Policy, and any applicable Non-Disclosure Agreement.
You agree that any comments or feedback you submit will not violate any third-party rights, contain unlawful, defamatory, abusive, obscene, misleading, or malicious content, or contain viruses, malware, or harmful code.
SECTION 14 - PROHIBITED USES AND SITE SECURITY
You may not use the Site, products, or services for any illegal, prohibited, infringing, fraudulent, abusive, harmful, or unauthorized purpose, or in violation of any applicable laws, regulations, or third-party rights.
You must not upload, transmit, distribute, or introduce worms, viruses, malware, malicious code, scraping tools, automated abuse, or other harmful materials that may damage, disrupt, interfere with, overload, or compromise the Site, PCBWay’s systems, or any third-party systems.
You may not collect or track personal information of others, impersonate another person, submit false or misleading information, interfere with security features, or attempt to gain unauthorized access to any part of the Site, systems, accounts, or data.
PCBWay may suspend, restrict, or terminate access to the Site or services for any prohibited use or security risk.
SECTION 15 - DISCLAIMER OF WARRANTIES
Except as expressly stated by PCBWay in writing, the Site, online tools, information, products, and services are provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.
PCBWay does not guarantee that the Site or services will be uninterrupted, timely, secure, error-free, or that all website information will always be accurate, complete, or current. Nothing in these Terms excludes or limits any warranties, rights, or remedies that cannot be excluded or limited under applicable law.
SECTION 16 - LIMITATION OF LIABILITY AND NON-EXCLUSIVITY
To the maximum extent permitted by applicable law, PCBWay shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business, loss of data, production interruption, or replacement costs, arising out of or related to your use of the Site, products, or services.
To the maximum extent permitted by applicable law, PCBWay’s total liability for claims arising from or related to an order shall be limited to the amount paid by you to PCBWay for the order giving rise to the claim.
Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law, including liability arising from fraud, willful misconduct, gross negligence, or breach of confidentiality obligations.
The relationship between you and PCBWay is non-exclusive. PCBWay may provide manufacturing services to other customers, including customers with similar or competing products, provided that PCBWay will not use your confidential Customer Data, technical files, drawings, or specifications for the benefit of any third party without your prior written consent.
SECTION 17 - INDEMNIFICATION
You agree to indemnify and hold harmless PCBWay, its affiliates, officers, directors, employees, agents, suppliers, service providers, and contractors from and against actual losses, claims, penalties, fines, damages, liabilities, and reasonable legal costs arising from your breach of these Terms, violation of applicable law, infringement of third-party rights, inaccurate information, or misuse of the Site, products, or services.
SECTION 18 - SUSPENSION AND TERMINATION
These Terms remain effective unless terminated by you or PCBWay. You may stop using the Site or services at any time, subject to outstanding orders, payment obligations, legal obligations, compliance obligations, and provisions that by their nature should survive termination.
PCBWay may suspend, restrict, cancel, or terminate your account, order, or access to the Site or services if PCBWay reasonably believes that you have breached these Terms, failed to pay amounts due, provided inaccurate information, created legal or compliance risk, violated trade compliance requirements, misused the Site, or failed to cooperate with reasonable review requests.
Termination does not affect rights, obligations, liabilities, or remedies accrued before the termination date.
SECTION 19 - SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
PCBWay’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with any policies or additional terms referenced herein, constitute the entire agreement between you and PCBWay regarding your use of the Site and services, unless a separate written agreement has been signed by both parties.
SECTION 20 - GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and any separate agreements under which PCBWay provides services to you shall be governed by and construed in accordance with the laws of Hong Kong, unless otherwise required by applicable law.
Any dispute arising out of or in connection with these Terms shall be submitted to the Hong Kong International Arbitration Centre for arbitration in Hong Kong. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.
SECTION 21 - CHANGES TO THESE TERMS
PCBWay may update, change, or replace these Terms from time to time by posting the revised version on this page. The latest version will be available on the Site.
Your continued use of or access to the Site after any changes are posted constitutes acceptance of those changes. Changes to these Terms will not materially affect orders already accepted by PCBWay, unless required by applicable law, regulation, compliance obligations, or agreed by both parties.
